DMCA Notice & Takedown Policy

DEZER Platinum Realty respects the intellectual property rights of others and expects its users to do the same. It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this website, please notify us by submitting a DMCA Notice (as described below) to our Designated Copyright Agent.

Filing a DMCA Notice

To file a DMCA Notice, please provide the following information in writing to the Designated Copyright Agent listed below:

1. Identification of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by this notice, you may provide a representative list of such works.

2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit [Your Company Name] to locate the material. Please provide the URL(s) of the allegedly infringing material.

3. Information reasonably sufficient to permit DEZER Platinum Realty to contact you, such as an address, telephone number, and, if available, an email address.

4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. Your physical or electronic signature (typing your full name will suffice as an electronic signature).

Upon receipt of a valid DMCA Notice, DEZER Platinum Realty will take appropriate action, including removing or disabling access to the allegedly infringing material.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are not sure whether the material you are reporting is infringing, you may want to contact an attorney before filing a notification with us.

Counter-Notice
If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notice with [Your Company Name]'s Designated Copyright Agent. To be effective, a counter-notice must include:

1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

2. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in [the judicial district in which your address is located], or if your address is outside of the United States, for any judicial district in which [Your Company Name] may be found, and that you will accept service of process from the person who provided the DMCA Notice or an agent of such person.

4. Your physical or electronic signature (typing your full name will suffice as an electronic signature).

If a counter-notice is received by the Designated Copyright Agent, DEZER Platinum Realty may send a copy of the counter-notice to the original complaining party informing them that it may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the user, the removed material may be replaced, or access to it restored, in 10 to 14 business days after receipt of the counter-notice, at DEZER Platinum Realty's discretion.
